Speeding Reduced to Failure to Pay Full Time and Attention under the Fairfax City Code

Client was driving to work and running late. There was some traffic so they sped up to pass another vehicle. Unfortunately there was a Fairfax City Police Officer running radar at that moment and they were cited for driving 63mph in a 35mph zone. The client had a good driving record so the Officer did not charge them with reckless driving as they could have given the speed was more than 20mph over the speed limit. The Officer issued the client a speeding ticket.
Because prepaying the speeding ticket would result in a loss of 6 demerit points on their DMV record the client reached out to us to help minimize the charge. Car insurance is getting more expensive so it's not surprising that people want to keep a good driving record. We regularly appear in the Fairfax City courthouse so we had our client take two online defensive driving courses and brought them to court. The client did not need to appear.
After negotiation with the Fairfax City Prosecutor the charge was amended (reduced) to Failure to Pay Full Time and Attention under the Fairfax City Code. This is significant because this reduced offense (local ordinance) is not transmitted to the Virginia DMV record. This will result in our client keeping a clean driving record.
