Driving with a Suspended Driver's License Dismissed in Fairfax County

Client was stopped for speeding by a Fairfax County Police Officer. They did not have their driver's license with them which they admitted to the police officer. They had figured their driver's license ID had just expired and had not gotten around to getting an updated license since they took Uber a lot anyway. Unfortunately their license came up in the DMV system as suspended. The Officer gave them a ticket for driving on a suspended license which is a Class 1 Misdemenaor in Virginia. Unbeknownst to the client their license was suspended by the Virginia DMV because of a prior DUI charge from many years ago. This was because they were ordered to complete the Alcohol Safety Action Program ("ASAP") years ago which they had completed but, because they never paid the ASAP fee, they were returned to the DMV as unsuccessful. Upon a conviction for a DUI in Virginia a person is ordered by the court by statute to complete ASAP. If they don't complete the program the DMV will not reissue a valid driver's license.
To fix this we had the case rescheduled a few months and the client re-enrolled and successfully completed the ASAP class. ASAP notified the Virginia DMV which reinstated their driver's license. We brought his now valid driver's license to court and the prosecutor agreed to dismiss the charge. This avoided another misdemeanor conviction and any further license suspensions.
