What is a Highway Sign?
Highway Signs are a system of traffic control devices designed for traffic control. Examples of Highway Signs are road signs such speed limit markers, signs dictating permitted turns, stop signs, etc. Consequently, failure to obey a highway sign under Virginia Code §46.2-830 is a very broad statute encompassing a wide range of driving behavior. In fact, the code simply requires that "All drivers shall obey lawfully erected traffic control devices." As a result, police officers write failure to obey highway sign charges in a wide array of driving instances.
In some cases, police officers will write a ticket for failure to obey a highway sign when someone is alleged to have been caught speeding. In most cases this is a lesser charge than a speeding ticket so sometimes we will recommend our client simply prepay the ticket. However, in those cases where our client has a clean driving record, we may still be able to help get the charge reduced or dismissed in Prince William County.
