Speeding Reduced to Failure to Pay Full Time and Attention in the Town of Herndon

April 2025

Client was charged with speeding at 40/25 zone in the Town of Herndon in Fairfax County.  There was nothing extravagant about the case as they were simply driving home from work.  Herndon has lower speed limits in the town so there are a lot of speed traps.  The client could have prepaid the ticket but speeding at 40/25 is 4-points for DMV purposes and would likely have impacted insurance.  He hired us to handle his speeding case.

We had our client take a defensive driving course and appeared on our client's behalf for court.  Our client had a clean driving record in Virginia.  In this case our client had not been licensed in Virginia for very long and had been licensed previously in Florida.  They pulled their Florida driving record for us along with their Virginia driving record.  This helped us show the Herndon Town Attorney that our client had a very clean record for the better part of 10 years.  As a result, the speeding offense was reduced to Failure to Pay Full Time and Attention under the Herndon Town Code with a fine.  Failure to Pay Full Time and Attention is not transmitted to the DMV as it is a local code.  Their driving record will remain clean after this case.
