Reckless Driving by Speed in Fairfax County Reduced to Improper Driving
April 2025
Client was driving home around midnight from a birthday party earlier in the day. They were stopped by a Fairfax County Police Officer for driving 76/50 zone. Due to the elevated speed the officer wrote them a ticket for reckless driving. Alcohol was not a factor in this case. Rather than appear in court by themselves they made the decision to hire our traffic attorney.
Client had a clean driving record. As a side note they did have old tickets but they had fallen off the driving record. Traffic Tickets will be removed from the driving record after a period of time by the Virginia DMV. It's always best to pull the driving record just to see what is on it before proceeding with the case in court.
We had our client take an online defensive driving course and their charge was reduced to Improper Driving. Improper Driving a 3-point offense for DMV purposes and falls off the driving record after 3 years. Most importantly it is a traffic infraction. They did not need to appear for court and we kept them updated on their case that morning by phone.
