Reckless Driving by Speed Reduced to Speeding in the Town of Herndon

March 2025

Client was stopped by a Town of Herndon Police Officer for driving 52/25 and issued a ticket for reckless driving.  They were a little frustrated because they had gone to Starbucks earlier and had quickly grabbed their drink order.  However, upon getting down the road, realized they had received the wrong order.  In addition, they had a work meeting they had to get to and were rushing to fix their drink order before going to work.

The client had a good driving record but, since they were going double the speed limit, we recommended they take an online defensive driving course.  We appeared for their case in the Town of Herndon General District Court.  The client went to work that morning and we handled their ticket in their absence.  After explaining what happened with the Town Attorney the charge was lowered to speeding at 9-over with small fine.  This reduced speed removes the reckless driving component and avoids a conviction for the original misdemeanor charge leaving just the speeding infraction.  The Town of Herndon General District Court is a part of the Fairfax County Court system but is in a different courthouse.  The roads in the Town of Herndon have very low speed limits so it's easy to exceed the speed limit and the Town of Herndon Police are constantly running radar in these areas.  To get the best result for your case it's always a good idea to consult with a traffic lawyer that regularly appears in Herndon.  In some cases we can appear on your behalf for court so you can go on about your day and let us handle the case for you.  The Town of Hendon Court is heard on most Wednesdays and is run similar to the Fairfax County General District Court with the main difference being that court is a 9am.
