Fairfax County Reckless Driving by Speed Reduced to Improper Driving

Client was driving to work at Dulles Airport on I-66 and was running late. Their speed got away from them and were stopped by a Virginia State Trooper driving 102mph in a 55mph zone and issued a ticket for reckless driving. This was a big deal because, at excess of 100mph, a person faces a jail sentence in addition to a loss privilege to drive. Judges in Fairfax County issue strict punishments at this speed so hiring a local traffic attorney is very important.
The good news is the client had a clean driving record out of Maryland. Given the speed involved we had them take a defensive driving course, a reckless driving course, get their speedometer calibrated, and perform some community service hours prior to court. As expected, at the court date, the prosecutor would not offer a plea agreement that we liked so we requested a continuance from the Judge and set the matter down for trial. Getting a 100mph reckless driving charge lowered is very difficult but, at the next hearing, we were successful in this particular case. Their charge was reduced to Improper Driving which is a traffic infraction. This also avoided any jail or license suspension issues. Just as important they were able to keep their job at Dulles Airport (which requires driving). While this is not a routine disposition it can happen if the client does a lot of pre-court preparation. We like to get the trooper onboard with what we're trying to accomplish because that can help when a prosecutor or Judge is deciding on what to do in a case. This is why in large part it's always a good idea to be polite with the police on the side of the road. You don't necessarily need to smile a them upon receiving a ticket but keeping things at least friendly can payoff in your favor in court later.
