Speeding in a School Zone Reduced to Defective Equipment in Prince William County

Client was driving to pick up their child at Elementary School and was stopped for driving 42/25 in a school zone and issued a speeding ticket. We looked up the school's opening and closing times and the client just within the time-period of which the school zone criteria applies. However, their child had stayed late so there were no crossing guards or other children in the area at that time. This was more of a minor oversight.
Our client had a good driving record so we had them take an online defensive driving course and appeared for court on their behalf. In court the officer agreed no one was in danger so the charge was reduced to defective equipment, a no-point non-moving violation in Virginia. This avoided the 4-point school zone speed charge from appearing on their driving record. The client's DMV point balance won't change and their insurance is far less likely to be affected. By hiring a traffic lawyer we were able to minimize the facts of the case to the court. Even though it was a school zone the spirit of the law didn't apply because there were no other students around the road area where our client was driving.
