Reckless Driving by Speed Reduced to Improper Driving in Loudoun County
March 2026
Client was driving on Route 28 in Loudoun County. Route 28 is a very large road so it's easy to speed and not realize it. A State Trooper happened to be driving behind our client and paced them at 87mph in a 55mph zone. There were no issues with the stop but the client was cited for reckless driving due to the speed. By statute pace is an acceptable method of judging speed (though not without its issues). A trooper can also use Radar and LIDAR to judge speed.
Client did have a prior traffic record but it certainly wasn't extensive. They took the 8-hr defensive driving course and 4-hr reckless driving course for mitigation for the court. We had our client appear in court because the Loudoun County General District Court can be strict on these types of speeds. However, we able to negotiate a reduction of the reckless driving to improper driving with a fine. This avoided the original misdemeanor charge and resulted in a conviction for a traffic infraction instead. Improper Driving is 3 points on the DMV driving record and will fall off the VA DMV record after 3 years.
