Reckless Driving Reduced to Failure to Pay Full Time and Attention in Fairfax City

Client was driving to the gym and simply tried to pass another vehicle. They were stopped by a Fairfax City Police Officer. The Fairfax City municipality has lower speed limits so it's easy to speed in that area. The client was charged with reckless driving at 57 mph in a 35 mph zone. This is because, in Virginia, it is Reckless Driving to drive at 20 mph or more over the speed limit. The client was required to appear in the Fairfax City General District Court. However, they appeared "through counsel" so they did not need to go to court.
Our client was a 21-year college student with a clean driving record. We had them take a defensive driving course and reckless driving course prior to court. They also had a good college GPA so we had them pull their college transcript. We like to use our client's background information anytime we can for court because it's helps humanize them.
Based on our client's age, good driving history, completion of two different driver courses, and lack of traffic affected the charge was lowered to Failure to Pay Full Time and Attention under the Fairfax City Code. This does two things: It avoids the original misdemeanor charge and avoids points from going onto the driving record.
