Unauthorized Inspection Sticker Dismissed in Loudoun County

Client was stopped on the Dulles Road in Loudoun County for a minor traffic violation. Unbeknownst to our client, he was driving a vehicle with an illegal inspection sticker. He had gotten his vehicle inspected at a local gas station and it appeared that they either unintentionally or intentionally put on a fake inspection sticker that had previously belonged to another vehicle. The client was surprised to learn that an Unauthorized Inspection Sticker ticket issued pursuant to Virginia Code § 46.2-1173 is a Class 1 Misdemeanor. We had our client fix the issue and get a proper inspection sticker installed on the vehicle. We appeared with the client in the Loudoun County General District Court and explained to the prosecutor that our client was unaware that the inspection sticker was fake and, in any event, that the issue was resolved. The prosecutor agreed to dismiss the charge and our client avoided a Misdemeanor conviction. The statute makes it clear that the person must "knowingly" possess a fictitious or counterfeit inspection sticker which makes sense given we entrust our vehicles to a service station without any clue about whether or not we are receiving a valid inspection sticker.
