Speeding in Fairfax County Reduced to Failure to Pay Full Time and Attention

Client was stopped on the Fairfax County Parkway for driving 71mph in a 50mph zone. The Officer did not cite our client for reckless driving but for speeding. This is certainly important. However, in Virginia, driving in excess of 20mph over the speed limit is 6 points on the driving record for DMV purposes and insurance can be affected.
Client hired us and we had our client take both a defensive driving course and reckless driving course. Client was not cited for reckless driving but could have been so the additional course was important. We also wanted the Judge to see the extra work our client put into his case. Client also had a clean driving record out of Illinois.
We spoke to the police officer and recommended a reduction to the County Code failure to pay full time and attention. The officer was onboard. Since as of now prosecutors are not involved in speeding tickets in Fairfax we went directly before the Judge. We provided the Judge with our mitigation and our proposal to the reduction. The police officer told the Judge they had spoken with me and that was an acceptable resolution. The Judge agreed and lowered the charge to failure to pay full time and attention with a fine.
Instead of a 6-point speeding ticket our client will now receive no points and nothing on his driving record. This is why hiring a traffic lawyer can really change the outcome of a case. This because of preparation prior to court and proper discussion in court.
