Reckless Driving Speed Charge reduced to Speeding at 9-over in Fairfax County

September 2023

Client was stopped and ticketed for reckless driving off Frying Pan Road in Fairfax County.  The police officer got her on radar going 64mph in a 35mph zone.  She was simply driving home and didn't realize her speed.  There were no other issues going on.

We went to court on her behalf (she did not need to appear in this particular case).  She had a perfect driving record and took an online defensive driving course.  She was polite with the police officer during the traffic stop.

Due to her good record, having taken the defensive driving course, and having been polite with the officer, her charge was reduced to 9-over at 44mph in a 35mph zone.  This avoids a misdemeanor conviction for reckless driving and results in a low-level speeding ticket instead on her record.

We always recommend people go to court with a lawyer for reckless driving charges because it is a misdemeanor charge and many Judges do not reduce reckless driving charges simply because someone asks them to.  While sometimes we have to go trial before a Judge we can also negotiate with the prosecutor for a reduction in many of reckless driving by speed charges we have.
