Going Through a Red Light in the Town of Vienna Reduced to Failure to Pay Full Time and Attention

Client was driving through the Town of Vienna after dropping off their sister at Vienna Metro when they came to a green light that was cycling to yellow.  Unfortunately it was icy conditions on the road.  When the light turned red it was unclear if they could stop in time and simply slide into the intersection causing a crash.  The client thought it would be safer to proceed through the red light versus taking the risk of trying to stop in time.  Client was ultimately cited for disregarding a traffic signal by a Town of Vienna Police Officer.

Our client had a good driving record.  When we have traffic court it's always a good to take a defensive driving course even under the facts of this case.  We explained what happened to the Vienna Town Attorney who agreed to lower the charge to Failure to Pay Full Time and Attention under the Vienna Town Code with a fine.  Failure to Pay Full Time and Attention is not reported to the DMV so it won't appear on the client's driving record.  As a result, no DMV demerit points will be assessed on our client's driving record.

Sometimes we get issued a ticket when it seems unfair given the circumstances.  This case seems to fall under that umbrella.  It was winter time with icy conditions and the client thought they made the right call to go through the red light to avoid possibly skidding into the middle of the intersection putting everyone at risk.  Hiring a traffic attorney in the jurisdiction in which the ticket was issued is always a good idea to help get the best results possible.
